Terms of sale

1. Scope

(1) These terms of sale apply to all contracts for the delivery of goods that a consumer or business customer (“you”) concludes with ATELIER 3K GbR (“we”) via our online shop.

(2) We do not accept your conflicting terms unless we expressly agree to them in writing.

2. Contracting party and contract formation

(1) The purchase contract is concluded with ATELIER 3K GbR.

(2) Product listings are invitations to order. By clicking “Order with obligation to pay” you submit a binding offer for the goods in your cart. An automatic order acknowledgement is not acceptance. We may accept within five days by order confirmation email or by shipping the goods.

3. Prices, shipping costs, payment

(1) All prices are in euros and include statutory VAT.

(2) Additional shipping costs are shown in the cart and before you complete checkout.

(3) Payment methods offered at checkout (e.g. prepayment, PayPal, Klarna, Wero) are processed via Mollie. Payment is due on conclusion of the contract unless another method (e.g. buy now pay later) is expressly agreed.

4. Delivery, made to order

(1) We deliver to the address you provide within Germany and, where offered at checkout, to other countries.

(2) Knitpieces are generally produced after your order (made to order). Estimated production and delivery times are shown at checkout or confirmed in the order confirmation.

(3) Partial deliveries are permitted where reasonable for you.

5. Retention of title

Goods remain our property until paid in full.

6. Warranty

Statutory warranty rights apply. For used goods, warranty may be limited where permitted by law.

7. Liability

We are fully liable for intent, gross negligence and injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage.

8. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are in our withdrawal policy. For custom-length pieces made to your specification, no withdrawal right applies under § 312g (2) no. 1 German Civil Code (BGB) where permitted.

9. Dispute resolution

We are not obliged to participate in consumer arbitration proceedings.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules in your country of residence remain unaffected.
